Wills and Powers of Attorney

Most people will have heard the stories about what can happen to the estate of someone who dies without making a will. At best it can lead to delays and distress to the family. The worst case is where no next-of-kin can be traced at all and after payment of debts and the expense involved in trying to trace relatives the residue of the estate will go to the government.

You may think that there is no need to make a will because everything will go to your wife or husband anyway. Wrong -the fact is that only small estates go to the spouse solely. There are circumstances when children or even more distant relatives may be entitled to a share, and what happens if you and your spouse were in an accident together?

If you are separated or divorced you must consider making a will or changing your existing will.

The other advantages of making a will can be summarized as follows: -

• The appointment of Executors of your choice and guardians for your children
• Special gifts of money, property or chattels
• Creation of trusts and extended Trustees powers
• Tax planning
