Matrimonial and Family Problems

When any relationship, married or otherwise, breaks down there are considerable tensions between the parties involved, which can cause them to become very emotional. It is important that when advice is given this does not worsen the situation. The Bemrose & Ling Family Law team is both experienced and sympathetic to family problems. All situations are approached to see if agreement can be reached on an amicable basis, and if so, that is the approach that will be taken.

At all times we consider, with the Client, the role of an independent mediator who could become involved not to give advice, but who may assist your case as an alternative way of settling the difference without using the last resort of the Court.
There are cases where it may be necessary for Court Proceedings to be issued. We are experienced in using the County Court and Family Proceedings Court to either resolve difficulties or obtain an appropriate court order.

The firm is experienced in all matters in relation to separations, separation agreements, divorces, redistribution of matrimonial property, advice on pensions following divorce and any other matter which might arise from the breakdown of a relationship. The firm has a Legal Service Commission contract for family work that ensures the work is of a consistent standard and that public funding is available for all cases where the financial criteria is fulfilled.

Children

Bemrose & Ling has particular expertise in this area of Law. Iain Donald and Rob Duffin have been members of the Law Society’s specialist Children’s Panel for a number of years and have conducted cases concerning children in Courts at all levels. There may be instances when a Client has to use the Courts to resolve differences that sometimes cannot be resolved immediately. Specialist advice is available on all these issues.

We also deal with a considerable amount of work that involves the representation of parents or children in Court Proceedings brought by the Local Authority’s Social Services Department. For example, the Local Authority might be seeking a Care Order in respect of children; representation is available at all levels.

Domestic Violence

Bemrose & Ling has many years of experience in dealings with cases involving domestic violence. Often an emergency arises with cases where a Court Order, for example, is needed to provide protection for one party to a relationship or even in respect of children. Emergency Court Orders can be obtained on the same day that instructions are given in extreme circumstances. Again, the firm’s holding of a Legal Service Commission contract allows public funding in urgent cases to be granted immediately.
